INTRODUCTION

By accessing our website and/or placing an order you are agreeing to comply with and be bound by our terms and conditions. These terms and conditions have been created to protect your rights as a valued customer and to form the basis of an understanding between you as the customer and us as a business. The terms and conditions set out below do not affect your statutory rights.

The pages on our website are subject to change without notice. We may at any time revise these terms and conditions, so we recommend you check every time you order from us. Our website contains material which is owned by or licensed to us and reproduction is prohibited without permission. Unauthorised use of our website may result in a claim for damages and/or be a criminal offence.

We guarantee to abide by all the conditions of the consumer protection laws including the Sale of Goods Acts and the Consumer Contracts Regulations. All the products supplied by us comply with current British or European standard requirements. Whilst we endeavour to ensure that the information on our website is correct we acknowledge that occasionally there may be inaccuracies or other errors. We exclude any liability for such inaccuracies and errors. It is your responsibility to ensure any products and information meets your specific requirements.

Please remember to check the dimensions of the product carefully as it can often look smaller in the picture. We make every effort to display colours accurately on our website, but we cannot guarantee that your computer’s display will accurately reflect the colour and your products may vary slightly from the images. Almost all of the light fittings we supply will require some degree of assembly. If you are unsure about anything or have any questions, please contact our sales team before you place your order.

PRICE

Where the Goods are sold by AMONAX, then the price of the Goods shall be the price stipulated on www.amonax.com at the date of the Contract. However due to market conditions prices do fluctuate. For the avoidance of doubt the most current price, and the one that will apply in respect of any Contract, will always be the one displayed on our website at the time the Contract is formed. All prices are fixed at the date of the Contract and will only subsequently be varied by agreement in writing by both the Buyer and the Seller. For the avoidance of doubt, unless otherwise stated, prices quoted for Goods in the Catalogue and on the Website are shown per item.

Whilst AMONAX undertakes every effort in order to prevent any errors and / or omissions in the Catalogue and on the Website, mis-pricing may occur. AMONAX reviews all prices as part of its order processing system, and in the event that the goods’ correct price is lower than that stated on the Website or the Catalogue (as applicable) then we will charge the lower amount and process the order accordingly. In the event that the goods’ correct price is higher than that stated on www.amonax.com, we will, in its entire discretion, either: 1) contact you for instructions prior to dispatch of the order; or 2) cancel the order, notify you of such cancellation and refund the Buyer any sums that they have paid.

AMONAX reserves the right to charge such taxation including and without any limitation any charge, tax, duty, levy, impost, withholding or liability wherever chargeable imposed for support of national, state, federal, municipal or local government or any other person or whether of the UK or any other jurisdiction on the Goods in accordance with the Waste Electrical and Electronic Equipment Directive and/or its United Kingdom equivalent.

ORDERING AND PAYMENT

Our shopping pages will guide you through the steps you need to take to place an order with us. There is no minimum order requirement. All payments must be in British Pounds Sterling. You can pay for products using most major debit cards or credit cards, from a PayPal account or by redeeming one of our gift vouchers. Payments can be made by BACS transfer by request. You are required to make payment for the whole amount of your order (including any delivery charges if applicable) at the time your order is placed. Online transactions are processed shopify - a leading internet payment processing company and transactions are 100% secure.

All online payments are subject to a fraud security check prior to any order being accepted. We reserve the right to refuse any order for any reason. If an order is refused any money paid will be refunded by the original method of payment.

If you have been given a promotional discount code, you will be able to enter this during the checkout process. These codes are non-transferable, and you must ensure you are eligible to use the code.

If you wish to cancel an order before delivery has been arranged, please inform us in writing as soon as possible from the same email address used to place the order.

Once you have placed an order on our website you will receive an automatic acknowledgement. If you do not receive this email, please let us know. Please check your spam folder first.

VAT Value Added Tax is included in your checkout total. The rate may change and the current rate is 20% for orders made from the UK.

INSTALLING YOUR PRODUCTS – WHEN TO BOOK AN ELECTRICIAN

AMONAX advises against booking an electrician until you've received your order and had the chance to check its condition. In the unlikely event that it is damaged or that items are missing, this might avoid needless call-out charges. Unfortunately, we cannot be responsible for any charges from contractors in the unlikely event that your order is delayed, damaged or that the product you have selected is not suitable for its intended purpose.

WHAT TO DO IF I RECEIVE DAMAGED GOODS?

Lighting products tend to be fragile. However, our highly experienced carriers handle such goods every day and we're confident that our robust packaging will prevent damage to breakable items in transit. Despite our best efforts though, accidents do occasionally happen. Please inspect your order within 24 hours of arrival and report any damage to us within 14 days and we'll be happy to address any problems and help with the return and replacement of your order.

YOUR LIABILITY AS A CUSTOMER

If you are a Consumer we are under a legal duty to supply Goods that are in conformity with the Contract. Nothing in these terms will affect your legal rights. If you wish to exercise your legal rights to reject Goods you must post them back to us or (if they are not suitable for posting) allow us to collect them for you. We will pay the costs of postage or collection in the event where goods delivered in damaged condition. Please contact us for a return information.

AMONAX is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process and our breach of the Contract or failure to use reasonable care and skill causes the loss or damage that you discussed with us. We are not responsible for loss or damage that you suffer that is caused by any failure by you or another person to install the Goods correctly. AMONAX only supply the Goods for domestic and private use. If you use the Goods for any commercial, business or re-sale purpose our liability to you will be limited.

We do not in any way exclude or limit our liability for: 1) death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; 2) fraud or fraudulent misrepresentation; 3) for breach of your legal rights in relation to the Goods; and 4) defective products under the Consumer Protection Act 1987.

EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below:

1) An "Event Outside Our Control" means any act or event beyond our reasonable control, including but not limited to strikes, lock-outs or other industrial action by third parties (i.e. which do not involve the our own staff), civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks which are not under our control, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport or import or export regulations or embargoes.

2) If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:

a) we will contact you as soon as reasonably possible to notify you;

b) we will take steps to minimise the delay; and

c) our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Goods to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

d) You may cancel a Contract affected by an Event Outside Our Control where there is a risk of substantial delay. To cancel please contact us. If you opt to cancel, you will have to return (at your cost) any relevant Goods you have already received and we will refund the price you have paid for the goods.
